The importance of registering your trademark
Your business's name, logo or slogan may be its most valuable asset. In Costa Rica, full trademark protection is obtained by registering it with the Intellectual Property Registry.
Without registration, you may use the name, but your position is weak: someone else could register it first and even demand that you stop using it, or benefit from the reputation you built.
With registration, you obtain the exclusive right to use the trademark for the registered products or services, and you can oppose confusingly similar uses, renew it and transfer it.
In general terms, the process involves verifying that no identical or similar trademarks exist for the same products or services, filing the application under the corresponding classes, and following the process before the registry.
This guide is general information and does not replace legal advice: the similarity study and applicable classes are analyzed for your specific business. Book a consultation and we will review your case together.
